By signing this application, I acknowledge, on behalf of myself and the Group, that (a) I have received a copy of the 2009 Toyota Project Rebound Program Terms and Conditions (the “Program Terms and Conditions”), (b) I have read and understand the Program Terms and Conditions, (c) I will distribute a copy of the Program Terms and Conditions to the Group, and (d) myself and the Group agree to abide by the Program Terms and Conditions. I acknowledge, on behalf of myself and the Group, that (a) the Program is subject to the Program Terms and Conditions, (b) the Group qualifies for participation under these Program Terms and Conditions, and (c) the WNBA Enterprises, LLC (“Sponsor”) shall determine the winners of the Program and its decisions shall be final and binding and not subject to challenge in any court of law. Should the Group win a prize, I will ensure that the Group and/or the local community organization listed herein fulfill all requirements imposed on winners as set forth in the Program Terms and Conditions. I acknowledge that the failure of myself and the Group and/or local community organization to fulfill such requirements may result in the Group’s disqualification. I acknowledge that the number of Qualifying Games (as defined in the Program Terms and Conditions) and the number of available group tickets that each WNBA team may have varies. Furthermore, I, on behalf of myself and the Group, our heirs, executors and administrators, hereby agree that Sponsor, WNBA Enterprises, LLC., WNBA, any WNBA team (collectively, the WNBA Entities”), NBA, NBA Properties, Inc., any NBA team, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) shall have no liability and will be held harmless by myself and the Group for any liability, loss, injury, claim, or damage to themselves or any other person or entity, including without limitation, personal injury, death, or damage to personal or real property, to a Group member or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, or misuse of a prize or participation in this Program.

I acknowledge, on behalf of myself and the Organization, that (a) the Program is subject to the Program Terms and Conditions and (b) the Sponsor shall determine the winners of the Program and its decisions shall be final and binding and not subject to challenge in any court of law. Should the Organization receive a prize, I will ensure that the Organization fulfills all applicable requirements as set forth in the Program Terms and Conditions. I acknowledge that my failure to fulfill such requirements may result in disqualification. Furthermore, I, on behalf of myself and my Organization, our heirs, executors and administrators, hereby agree that the Released Parties shall have no liability and will be held harmless by myself and my Organization for any liability, loss, injury, claim, or damage to themselves or any other person or entity, including without limitation, personal injury, death, or damage to personal or real property, to any person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, or misuse of a prize or participation in this Program.
