To participate in the promotion, visit PhoenixMercury.com and click on the Ladies Night Out button between June 13, 2009 and August 13, 2009 and enter to win by filling out the official entry form or printing it off or using a plain piece of paper and printing your name, street address (no P.O. boxes), city, state, zip code, date of birth (mm/dd/yyyy), and email address and mailing it to State Farm’s Ladies’ Night Out c/o Will Lloyd 201 E Jefferson St. Phoenix, AZ 85004. Failure to comply with this or any other official rule will result in disqualification. The Phoenix Mercury and State Farm Insurance are not responsible for inaccurate entry information or for lost, misdirected, late, incomplete, illegible or unintelligible entries, whether caused by participant or by any of the equipment or programming associated with or utilized in this promotion, or by any technical or human error that may occur in the processing of entries. Mechanically reproduced entries are not permitted and will be deemed void. There is a maximum of one entry per person. Illegible/incomplete entries are void. All entries must be received by midnight on September 1, 2008. All entries become the property of State Farm Insurance and will not be acknowledged or returned.
Prizes
Through a random drawing executed by the Phoenix Mercury, ten winners will receive two Suite Tickets to the August 13, 2009 Phoenix Mercury home game vs. Sacramento Monarchs; dinner for two in the suite (Approximate Retail Value: $157.00). Prize consists of only those items listed as part of the prize.
Prize Drawings
Random drawings from all eligible entries received will be held on approximately August 16, 2009. Winners need not be present to win. Winners will be notified by email via a “Notification Letter Email” or by telephone within two days of the drawing and followed up with a Notification Letter email. Winners may be asked to present a valid driver’s license or other form of identification at time of prize award for age verification. Transportation/parking is not included. Winners must be able to attend on Mercury-specified dates or prize will be forfeited. If game is delayed, postponed or cancelled for any reason, winner will not be reimbursed.
Entrants without proper address will be excluded from the drawing. Prize notification returned as undeliverable may result in an award to an alternate. No prize substitution, cash equivalent, or transfer of prize by winner in violation of these rules and regulations is permitted. The Phoenix Mercury reserves the right to substitute prize of equal or greater value. Promotion prizes are subject to all applicable federal, state, and local laws, rules and regulations. All federal, state, and local taxes, are winner’s sole responsibility. Prize acceptance constitutes acceptance of prize conditions and permission to use winner’s name and/or likeness for advertising/publicity purposes without further compensation, unless prohibited by law. Should a prizewinner make any false statement in connection with this Promotion, the winner will be required to promptly return to the Phoenix Mercury, upon demand, the prize. All prized are awarded “as is,” and without warranty of any kind, whether express or implied.
Odds of Winning
Odds of winning a prize depend on the number of eligible entries received in the drawing. Limit one prize per family/household.
Taxes and Expenses
Winners are solely responsible for any local, state and federal taxes. A 1099 tax form may be issued to a winner in connection with the prize. Any additional expenses incident to any prize are the responsibility of each respective winner.
Additional Terms
The Phoenix Mercury reserves the right, in its sole discretion, to modify, terminate, or suspend this promotion should viruses, bugs, unauthorized human intervention or other causes beyond the Phoenix Mercury's control corrupt or impair the administration, security or fairness of the promotion. The Phoenix Mercury and State Farm Insurance, and any of their respective agents are not responsible for any human error that may occur in the processing of the entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, whether caused by the sender or any of the equipment or programming associated with or utilized in this promotion. The Phoenix Mercury reserves the right, in its sole discretion, to disqualify any individual found to have tampered with the entry process or the operation of the promotion; to have acted in violation of these rules; or to have acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. The Phoenix Mercury and its agents are not responsible for any printing or technical error which may occur in processing, printing or distribution of promotion materials.
Miscellaneous
By participating in this promotion, participants agree to be bound by these rules. No transfer, assignment, cash redemption or substitution of prizes is permitted except by the Phoenix Mercury due to prize availability, and then with a prize of equal or greater value. By accepting prizes, winners agree that the Phoenix Mercury, the WNBA and its Member Teams, State Farm, Phoenix Arena Development Limited Partnership, Sports & Entertainment Services, L.L.C., and their respective parents, subsidiaries, affiliates, sponsors, directors, officers, governors, employees and agents will have no liability and will be held harmless by winners for any liability, loss, claims, injury or damage to property or to person, including death, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prizes or participation in this promotion, even if caused or contributed to by the negligence of the Phoenix Mercury, the National Basketball Association and its Member Teams, NBA Properties, Inc., Phoenix Arena Development Limited Partnership, Sports & Entertainment Services, L.L.C., and each of their respective parents, subsidiaries, affiliates, directors, owners, employees and agents. Participants agree that the decisions of the Phoenix Mercury related to this promotion and all drawings are final. By participating in promotion, winners consent to the use of their names, likenesses and/or voices for any advertising or promotional purposes without further consent or compensation. Winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner's name and/or likeness in any and all advertising promotions and other publicity conducted by the Phoenix Mercury, State Farm Insurance., the National Basketball Association and its Member Teams, NBA Properties Inc., and each of their respective parents, subsidiaries and affiliates, except where prohibited by law. Winners are solely responsible for the actions of any guests who accompany them to the game. If a minor is a guest, winner must be minor’s parent/legal guardian or minor must be accompanied by its parent/legal guardian as one of the guests who must sign all required paperwork.
