TERMS AND CONDITIONS
Program Period:
The 2008 WNBA Court of Dreams Program (the "Program") begins May 17,
2008 and ends June 29, 2008 (the "Program Period"). There are two
(2) components to this Program: 1) Sales Rep Incentive Program, and 2) Local
Community Program.
Sales Rep Incentive Program
This Program is open only to legal residents of the fifty (50) United States
or District of Columbia, 18 years of age or older who are salespersons employed
by WNBA teams. Eligibility will be determined by Sponsor, in its sole discretion.
The one (1) salesperson who is responsible for the largest Group (as defined
below) sales for up to six (6) Qualifying Games (as defined below) during the
Program Period across the League (as determined by Sponsor) will be receive
the following sales incentive award (a "Prize"): Top Seller: $1,000.
Prizes will be awarded in the form of a check. In the event of a tie in any
prize level, the salesperson with the highest total revenue from the qualifying
Group sale from among those tied will be the winner for that level. In the event
a tie still remains, the salesperson of the Group sale with the largest number
of tickets purchased to the first home game of the qualifying Group sale will
be the winner. Thereafter, the number of tickets purchased for each game of
the qualifying Group sales of such tied salespersons will be compared until
a winner for the applicable prize level is determined.
Local Community Program
Who Can Participate:
Any collection of individuals and/or organizations who are legal residents of
the fifty (50) United States or the District of Columbia, 18 or older (each,
a "Group") (i) that has assigned a leader to manage the Group's participation
in, and ticket order with respect to, this Program (the "Group Leader"),
(ii) that has identified, and obtained the written consent of, a local community
organization to receive any prize awarded, and (iii) whose leader has completed
the required application and related paperwork on behalf of the Group. Sponsor
reserves the right to approve or disapprove the designation of any Group.
Employees, and the immediate family members (spouse, child, parent and sibling
and their respective spouses, regardless of where they reside) and those living
in the same households, whether or not related, of the Women's National Basketball
Association (the "WNBA"), the National Basketball Association (the
"NBA"), any WNBA team, any NBA team, and any of their respective parents,
affiliates, subsidiaries, and advertising and promotion agencies, are not eligible
to be Group Leaders or to participate or win. Groups affiliated with any of
the above-mentioned entities are also not eligible.
How to enroll: A Group may participate by having the Group Leader fully complete
and sign the application form and return it to the Group Sales Department for
the WNBA team in its market so that it is received by no later than one week
prior to the first applicable Qualifying Game (For a list of Qualifying Games,
visit WNBA.com).
How it works:
A Group may purchase tickets (subject to availability) for up to six (6) WNBA
regular season games scheduled to take place between May 17, 2008 and June 29,
2008 (each, a "Qualifying Game"). To be eligible to win a prize, a
Group must (a) purchase a minimum of 250 tickets over the Program Period with
each ticket purchased for at least $9 and at the group rates published by the
WNBA team in its market as of May 1, 2008; (b) have its fully completed and
signed application received by its local WNBA team's Group Sales Department
by no later than one week prior to the first applicable Qualifying Game of the
order; and (c) purchase all qualifying tickets by date of the last applicable
Qualifying Game of the order (collectively, a "Qualifying Group").
A Qualifying Group's purchase may be limited by the number of group tickets
to a Qualifying Game that a team has available. The number of Qualifying Games
and the number of available group tickets that each WNBA team may have varies.
The total number of Group tickets will be verified through the team's ticketing
system. All disputes regarding this Program and the interpretation of these
Terms and Conditions will be resolved by the WNBA League office, and its decision
shall be final and binding, and not subject to challenge in a court of law.
This Program is subject to all applicable federal, state and local laws and
regulations and is void where prohibited by law.
Groups must submit all materials that they desire to send to their members regarding
this Program to the WNBA team in their markets for prior approval. A Group that
circulates materials without receiving WNBA team approval may, in the sole discretion
of the Sponsor, be disqualified.
Prizes: The local community organization designated by the Qualifying
Group across all fourteen WNBA team markets who purchases the most tickets (as
determined by Sponsor) (the "Grand Prize Winner") will receive its
choice of one of the following three (3) grand prizes (as indicated on the Qualifying
Group's application form): (1) choice of a new or refurbished indoor or outdoor
WNBA-identified basketball court at a local community organization (prize includes
new court painting and surfacing or resurfacing an existing basketball court,
with new basketball backboards, rims and nets; prize does not include anything
other as specified in these rules, e.g., the purchasing of land or any specific
construction or development costs or permits) (Maximum Approximate Retail Value
("ARV"): $25,000); (2) a Read to Achieve Reading and Learning Center
at a local community organization (prize includes books, computers, and WNBA-branded
signage, photography and memorabilia selected by Sponsor, in its sole discretion;
prize does not include anything other as specified in these rules, e.g., purchasing
of space or any specific construction or development costs or permits) (Maximum
ARV: $25,000); or (3) a $10,000 check payable to the designated local community
organization. Maximum Total ARV of all prizes: $26,000. In the event of a tie,
the Qualifying Group from among those tied with the largest total revenue will
be the winner. In the event a tie still remains, the Qualifying Group which
purchased largest number of tickets to the first home game of the Qualifying
Group sale will be the winner. Thereafter, the number of tickets purchased for
each game of the Qualifying Group sales of those tied will be compared until
a winner for the applicable prize level is determined. Only the local community
organization named on the application form will be eligible to receive the prizes.
All prize details are at the sole discretion of the Sponsor. Prizes will be
awarded "as is" with no warranty or guarantee, either express or implied
by Sponsor. No transfer, cash equivalents or substitutions permitted by Winning
Qualifying Groups or the local community organization. Sponsor reserves the
right to substitute a prize of comparable or greater value, at its sole discretion.
All federal, state and local taxes, if any, and all other costs or expenses
not specified herein as being awarded are the sole responsibility of the Winning
Qualifying Group and/or applicable local community organization.
General Terms & Conditions:
If there is no Qualifying Group in one or more WNBA team markets, no prize(s)
will be awarded in such market(s). The Group Leader(s) of the winning Qualifying
Group(s) may be notified by telephone and/or mail and he/she and an authorized
representative of the designated local community organization may be required
to execute and return an Affidavit of Eligibility, Liability Release and (where
legal) Publicity Release within five (5) days of date of issuance of notification.
If any prize notification letter is returned as undeliverable, or any Group
Leader or authorized representative of the designated local community organization
is unable to be contacted, or in the event of noncompliance with these Terms
& Conditions, or if required documents are not returned within the specified
time period by any Group Leader or the local community organization, prize or
award (if applicable) may be forfeited and, at Sponsor's sole discretion, awarded
to the applicable runner-up for the prize at issue. Sponsor, WNBA, any WNBA
team (collectively, the WNBA Entities"), NBA, any NBA team, and their respective
parents, affiliates, subsidiaries, and advertising and promotion agencies, and
each of their respective officers, directors, employees and agents (collectively,
the "Released Parties") are not responsible for (a) lost, illegible,
incomplete, inaccurate, late, delayed, undelivered, misdirected, mutilated,
stolen, or postage due applications, ticket purchases or mail; or (b) computer,
technical, mechanical, typographical, printing, human or other errors relating
to or in connection with the Program, including, without limitation, errors
which may occur in these Terms & Conditions, in connection with the administration
of the Program, in the announcement or awarding of the prizes, awards or bonuses,
in the processing of applications or ticket purchases (including ticket or revenue
calculation errors), or in any Program-related advertisements or other materials.
By participating, participants agree to be bound by these Terms & Conditions
and agree that: 1.) the WNBA Entities and their designees shall have the right
and permission to use (unless prohibited by law) the names, voices, city/state
of residence, photographs, and/or likenesses of the Group and its Group Leader
and salespeople for advertising and/or trade and/or any other purpose in any
and all media or format now or hereafter known throughout the world in perpetuity
without further compensation, permission, or notification; and 2.) the Released
Parties shall have no liability and will be held harmless by participant for
any liability, loss, injury, claim, or damage to themselves or any other person
or entity, including without limitation, personal injury, death, or damage to
personal or real property, to a Group member, salesperson or any other person
or entity due in whole or in part, directly or indirectly, by reason of the
acceptance, possession, use, or misuse of a prize or award or participation
in this Program. Released Parties are not responsible for any cancellation or
postponement of any scheduled Qualifying Game. Sponsor reserves the right, in
its sole discretion, to disqualify any individual or organization found to be
tampering with the process of participation or the operation of the Program
or to be acting in violation of these Terms & Conditions. Sponsor reserves
the right to cancel or modify this Program if fraud or any other factor beyond
Sponsor's reasonable control impairs the integrity of the Program, as determined
by Sponsor in its sole discretion. In such event, Sponsor reserves the right,
at its sole discretion, to award the Grand Prize to the Qualifying Group that
purchased the most tickets up to time of such action (as determined by Sponsor)
and to award the Sales Incentive awards to the salespeople who are responsible
for the three (3) largest Group sales for up to six (6) Qualifying Games in
a single order across the League (as determined by Sponsor) up to the time of
such action.
Winners List: For the names of the Winning Groups (available after July
15, 2008) or the sales incentive award winners, send a stamped, self-addressed
envelope for receipt by September 15, 2008 to: WNBA Enterprises, 450 Harmon
Meadow Boulevard, Secaucus, New Jersey 07094, Attn: WNBA Court of Dreams Program.
